Terms of Service

These Terms of Service ("Terms") govern the use of the Fydelup platform published by Eytan's Ltd., a company incorporated under Israeli law, registered under number 332382159, with registered offices at Berenice , Jerusalem , Israel, accessible at fydelup.io and app.fydelup.io.

Use of the service implies full and unreserved acceptance of these Terms. Anyone creating an account declares having read, understood and accepted these conditions.

Fydelup is a SaaS platform enabling businesses to manage their marketing communications via email, SMS and WhatsApp to their own customers. The service includes: contact management, campaign creation and sending, loyalty programmes, appointment booking, payments, analytics, and an AI assistant.

The user agrees to provide accurate information upon registration and to keep it up to date. The user is responsible for the confidentiality of their credentials. Any action performed from their account is deemed to have been performed by them.

The user agrees to:

• Only send messages to recipients who have given their consent or with whom they have a pre-existing customer relationship.
• Include a simple opt-out method in every message (email unsubscribe link, STOP SMS, WhatsApp opt-out).
• Comply with GDPR as the data controller of their contacts' data.
• Not send any unlawful, defamatory, misleading, obscene, violent content or content that infringes third-party rights.
• Not use Fydelup for unsolicited mass cold prospecting.
• Not circumvent the platform's security, quota, or moderation mechanisms.

Non-compliance may result in immediate account suspension without notice.

Personal data processing is governed by our Privacy Policy and our Data Processing Agreement (DPA). The user expressly acknowledges that for the data of their end customers, they act as data controller and Fydelup acts as processor.

Current prices are available at fydelup.io/pricing. Subscriptions are billed in advance, monthly or annually depending on the chosen plan. Any month started is due. Payments are processed by Stripe. Amounts are shown excluding tax; applicable VAT depends on the customer's country of establishment.

The subscription is taken out for the period indicated at sign-up and automatically renewed unless terminated. The user may cancel at any time from their account, effective at the end of the current period. Fydelup may terminate in the event of a material breach of these Terms, without notice or compensation.

Fydelup commits to best efforts to maintain 24/7 service availability, without absolute guarantee. Maintenance interruptions may occur, generally announced in advance.

The Fydelup platform, its content, trademarks, logos and source code are the exclusive property of Eytan's Ltd. No use other than strictly necessary for the service is permitted.

Content created by the user (campaigns, contact lists, etc.) remains their property. The user grants Fydelup a non-exclusive licence strictly limited to providing the service.

Fydelup provides a technical service. The content of sent messages and compliance with applicable rules (GDPR, applicable communications laws) are the sole responsibility of the user.

Fydelup's liability, if engaged, shall be limited to the amounts actually paid by the user in the 12 months preceding the triggering event.

These Terms are governed by Israeli law.

For Customers established in the European Union, mandatory consumer or SME protection provisions of local law shall remain applicable where they offer superior protection.

Any dispute shall be submitted to:

• the competent courts of Paris for Customers established in the European Union;
• the competent courts of Tel Aviv (Israel) for all other Customers.
